Feeling that an as kicking was imminent, I felt it would be sporting to issue a warning, throw the proverbial glove down and all that jazz.
To Maxwell Daly Independent Estate Agents
Dear Sir,
On 18th April 2008, I paid you 300 pounds in return for promised service in your capacity as a Lettings Agent. You stated that you would conduct a security check of my brother and me with regard to letting us XX South Park Avenue.
No Such Service has been Delivered.
You have made no reasonable attempt to inform me of how my money was spent.
Under the term, “Goods Not Delivered”, this situation is eligible for a county court claim.
If you do not pay me 300 pounds by 6th June 2008, I will issue a county court claim against you.
Yours Sincerely
Joe Jones-Jennings
4th June 2008
My 24th birthday. I got up at 11:00 and ate cake all day.
5th June 2008
I would have been happy to receive a cheque for 300 that day, but sensing that my adversary was a grade-A proverbial pancake chef I went back to the county court website and entered the details of the case. I saved the details on the website, but refrained from sending them.
6th June 2008
With the deadline elapsed and the postman on his way back to the office for a jam sandwich only one course of action remained.
Let Loose the Dogs of Law.
I submitted the details to the county court, and waited, and waited.
17th June 2008
I received the following from the courts:
Your Claim was issued on the 17th June 2008.
The court sent it to the defendant by first class post on the 17th June 2008 and it will be deemed to be served on the 22nd June 2008.
The defendant has until the 6th July 2008 to reply.
The Defendant May
- Pay you your total claim. - File an acknowledgement of service. - Dispute the whole claim - Admit that all the money is owed - Not reply at all.
I thought to myself “ass has been kicked”. I waited for Maxwell Daly’s response, and prepared myself for the various situations that might arise. I thought, he’ll either pay me the full amount, in which case whoop-whoop, or he’ll dispute it. If he disputes it, I get to go to court. In either case, a fun day out was to be had.
